论法律语言的模糊性

On the Ambiguity of Legal Language

模糊性是法律语言的基本特征之一,其成因是主客观因素相互作用的结果。文章认为法律语言的模糊性是一把双刃剑,合理运用可以促使法律的稳定性和灵活性达到有机的统一;用之失当,会使得法律在实践之中难以适用,为权力滥用提供可能。因此,模糊语言的使用要遵循法治理念,既要发挥其积极功能,又要规制其弊端。

Being one of the fundamental characteristics of legal language,ambiguity can be attributed to the interaction between subjective and objective factors.This article holds that the ambiguity in legal language acts as a double-edge sword,the rational application of which will contribute to the integration of the stability and elasticity of law.On the other hand,if irrationally applied,it will pose a considerable difficulty for the law to perform its functions,which will give a loose rein to the abuse of power.Therefore the application of legal language should be subjected to the concept of rule of law.
