On the Principle of Freedom of Contract and Its Restrictions

合同自由原则对市场经济的健康发展至关重要,主要包括订立合同自由、选择相对人的自由、决定合同内容的自由、决定合同形式的自由、变更或解除合同的自由等。合同自由不是无限制的自由,不是当事人的任意妄为,否则会产生种种弊端。我国市场经济强调社会公平,维护社会公共利益,对合同自由的限制系当然之理。这些限制主要包括诚实信用原则及其附随义务,在公用事业等领域的强制缔约,还有保险、运输等领域的格式条款等。

The principle of freedom of contract is central to the healthy development of market economy,including the freedom of conclusion of contract,the freedom of choosing the relative person and the contract contents in the format contract,the freedom to change or cancel the contract and so forth.But freedom of contract is not unlimited one,nor the bridle of the parties concerned,otherwise all kinds of social ills will occur.For China＇s market economy emphasizes social justice and safeguard the public interest,there is definitely truth in restrictions on freedom of contract system.These limitations consist of the principle of good faith and its attendant obligations,mandatory contracting in utility service,as well as such standard terms as insurance,transportation and so on.
