诚实信用原则之“帝王条款”探疑

King Provision upon Principle of Good Faith

诚实信用原则作为我国民法的一项基本原则,有关问题争论已久。本文首先介绍了诚实信用原则的国外和国内渊源,并对其内涵加以明确。然后对诚实信用原则作为民法原则之"帝王条款"提出四点质疑,认为诚实信用原则并非为民法所独有,但其应当作为民法之基本原则。并结合诚实信用原则之特征及与其他民法原则的关系,阐述其不应列为最高原则之理由,对"法官空白的造法委任状"作为诚实信用原则称帝之理由提出了质疑。最后,对我国目前诚信缺失之现象进行了分析,并提出了相关建议。

Principle of good faith is one of the essential principles of civil laws in our country.This article is to introduce the origins of this principle and its connotation to be clear,and then puts forward four questions upon the king provision of principle of good faith,eventually sticks to believe that this principle is not unique to the civil law,but should be used as the essential principle of civil law.And in the light of the characteristics of principle of good faith and its relationship with the other principles of civil law,this article also illuminates the reason that it shouldn＇t be regarded as the highest principle and challenges the reason of principle of good faith as the highest principle for judge making law blank warrant.Finally,this article analyses present lack of good faith in our country and figures out some suggestions.
