论我国惩罚性赔偿制度的完善

惩罚性赔偿具有多方面的功能,对稳定市场秩序,维护受害人权益具有重要意义。我国惩罚性赔偿制度已经初具雏形,存在的问题主要在于相关规定未能协调一致,多采用固定倍数的确定性赔偿而忽略损害的大小,而且适用范围过窄,考量因素未明确。在这些方面借鉴域外立法经验对我国惩罚性赔偿制度进行完善,将利于该制度功能的有效发挥。

The multiple functions of punitive compensation are essential in stabilizing the market order and safeguarding the rights and interests of aggrieved party.Punitive compensation system in our country has been taking shape,but major problems exist such as disagreement among regulations,lack of flexibility in considering compensation for damages due to fixed multiples,the narrowness in their scope of application,and unspecific aspects of considerations.The paper hence holds that the oversea experience is to be learned.In these aspects learning from respects in legislation will help improve relevant domestic legislations,and as a result strengthen the function of the punitive compensation system.
