摘要
建立健全法律风险防范机制目前已被要求作为企业法制工作的中心任务和提升企业核心竞争力的战略任务。法律风险管理根植于风险管理的相关理论,但有独立的法学理论、法律规范解释和司法实务研判支撑,同时也借鉴管理学、经济学、统计学等诸多学科的分析框架和工具,用于法律风险的管理过程之中。因此,企业法律风险管理体系是一个涵盖了法律风险识别、法律风险评价、法律风险控制、风险机制测评的动态循环体系。
Setting up and improving a legal risk prevention mechanism are the central task of enterprise＇s legal work and also are the strategic task of promoting enterprise＇s core competitive power.Legal risk management results from the related theory regarding risk management and from independent legal theories,law interpretations and judicial decisions as well.At the same time,it also uses the analysis framework and tool of management,economics and statistics and so on.Therefore,enterprise＇s legal risk management system is a dynamic and circulating system that includes the legal risk identification,the legal risk appraisal,the legal risk control and the check-up of prevention mechanism.
