由于对保险欺诈民事责任的法律性质、保险欺诈的构成要件、危害等方面存在认识上的误区,中国投保方保险欺诈民事责任制度存在很多问题。应确立保险欺诈民事责任性质为有别于违约责任和侵权责任的一种新的责任类型——法定责任,在此基础上完善投保方保险欺诈民事责任立法:增加投保方民事义务可操作性、完善其相关责任条款(《保险法》第16条和第32条)、明确投保方保险欺诈民事责任范围、增加保险欺诈民事责任主体和确立保险欺诈民事责任优先原则。

Due to the misunderstandings on the aspects of legal nature of the insurance fraud civil liability, insurance fraud constitutive requirements, and detriment, there are some problems in the insurance fraud of the insured in the civil liability system of our country. It shall perfect insurance fraud civil liability legislation of the insured on the basis of establis- hing the insurance fraud civil liability which is a new type of legal liability and is different from tort liability and liability for breach of contract. It shall increase the operability of the insured civil obligations, perfect the relevant liability clauses in accordance with Clause 16＆32 of Insurance Law, clarify the range of insurance fraud civil liability of the insured, increase the subject of insurance fraud civil liability, and establish the priority principle of
