我国物权法中的平等保护原则

平等保护原则体现了我国物权法的立法精神,是物权法的首要原则。平等保护体现在物权法对国家、集体和个人财产保护的各个方面,贯穿于整部法律的始终,符合宪法精神,具有鲜明的中国特色。确立平等保护原则,对于坚持和完善社会主义基本经济制度,发展社会主义市场经济,构建和谐社会具有重大意义。对平等保护原则的含义、确立依据等几个理论问题进行了较为详细的阐述,指出物权法对于平等保护原则的规定尚不完善,例如征收征用制度的规定,导致这一原则的贯彻执行存在着一定问题,所以需要一些切实可行的制度设计来进一步完善该原则。

Equal protection principle reflects the spirit of China＇s property law. It is the major principle of property law. Equal protection embodied in all aspects of property protection of the state, collectives and individuals in property law. It throughouts the law from beginning to the end. It conforms to the spirit of the Constitution and possesses distinct Chinese characteristics. Establish the principle of equal protection is of great significance for upholding and improving the basic socialist economic system, develop the socialist market economy and building a harmonious society. The article represents the meanings of the principle of equal protection ,the establishment of several theoretical issues based on a more detailed. The article points out the provisions of equal protection principle are imperfect, for example, the provisions of expropriation and requisition system. This leads to the implementation of this principle exists certain problems, so we need some practical system designs to refine the principles further.
