摘要
单位职工的违法生育行为虽然具有违法性和可罚性,但并不应当成为单位开除职工的理由。从劳动权方面,劳动权是关系劳动者生存的基本权利,不应当因为劳动者的违法生育事实而被轻易剥夺或限制;从企业规章制度方面,劳动纪律的内容应当与劳动行为有关,职工生育问题不在其中,也不能够成为开除职工的依据;从妇女权益保护方面,怀孕生育的妇女应当享有平等权和受特殊保护的权利。
The worker's behavior of illegal childbirth is illegal and punishable,but it should not be the reason of being dismissed.Right to work is the basic right for survival.Violating the birth control regulations should not be reason for deprivation the right of survival.Company regulations are supposed to concern working ethnics and behavior excluding the employees' family issues so it can not be the reference for dismissal.In terms of women right protection,having a family is the right for women to enjoy.
