世贸组织反补贴中“公共机构”的认定问题

Identification Problem of "Public Institutions" in Anti-subsidy of WTO

由于世贸组织成员国对《补贴与反补贴措施协议》(SCM)中的"公共机构"概念存在歧义性理解,从而加剧了一系列补贴与反补贴的国际贸易争端。实际上,公共机构是被赋予政府职权并履行政府职能的实体,对于中国国有企业和国有商业银行是否属"公共机构"的问题,亦应以此为标准。

The member states of WTO have different understandings of＂ public institutions＂ from SCM, so many international trade disputes of subsidy and anti - subsidy have appeared. In fact, public institutions should be entity with governmental power and function. Whether state -owned China＇s enterprises and commercial banks belong to＂public institutions＇should be judged by this standard.
