摘要
“小产权房”是否合法化的问题已成为“小产权房”问题争论的焦点内容。纵观中国现行法律,我们不难发现关于“小产权房”“违法”的相关立法之间存在着逻辑上和法律上的种种矛盾与冲突。笔者拟对我国现行关于小产权房的相关立法、规章等进行梳理,并分析研究,得出结论:“小产权房”应当合法化。并对我国“小产权房”合法化的途径做出自己的判断,使“小产权房”拥有明确的法律定位,从而促进我国“小产权房”合法化的步伐。
The legalization of "houses with limited property rights" has become the focus of relevant debates. In view of current Chinese laws, we can easily find a few logical contradictions and conflicts stating that they are "illegal". This paper studies relevant laws and regulations, and concludes that the said houses should be legalized.Meanwhile, the authors also present their own ways of legalization to clarify its legal status and speed up of its legalization.
