论少数民族文化遗产的法律保护

On the Legal Protection of Minority Cultural Heritages

新中国建立以后,我国政府采取了一定的措施来抢救和保护少数民族文化遗产,但相关工作的开展还存在许多问题,尤其相关法律制度很不完善。面对少数民族文化遗产的流失和保护工作的滞后的现状,国家应当注重以法律保护少数民族文化遗产,促进少数民族文化的传承和发展。这要求国家必须在法律机制上有新的突破,打破保护机制滞后于开发机制的局面,合理有效的保护少数民族文化遗产,维护世界文化多样性,促进中华文明和谐发展。笔者建议国家和各级地方政府能够结合少数民族文化遗产的特点,拟立专门法律、完善现有制度,为合理有效的抢救和保护少数民族文化遗产、促进少数民族文化的传承和发展提供有力的法律保障。

Since the foundation of New China, the people’s government of China has adopted certain measures to rescue and protect minority culture heritages. However, issues exist in related work, especially in the legal system. In the condition of loss or poor protection of minority cultural heritages, the nation should provide legal protections to the field so as to promote the inheritance and development of minority culture, which requests that the nation should have new breakthrough on legal institutions, changing the situation of protection mechanism lagging behind exploration mechanism, providing effective protections to minority cultural heritages for the maintenance of cultural diversity in the world and harmonious development of Chinese civilizations. It is suggested that governments of different levels, on the basis of the characteristics of minority cultural heritages, should enact a specialized law and improve existing system so as to provide effective protection to minority cultural heritages as well as to promote the inheritance and development of traditional minority culture.
