摘要
《鹿特丹规则》首次设计了"海运履约方"制度,确定了非合同主体的责任基础,扩大了非合同责任主体范围,部分突破了合同相对性原则,更利于货方索赔和权利救济;"海运履约方"与承运人同等承担义务和赔偿责任,全面加重了义务、风险。该制度预期对中国航运、物流业产生全面影响,应当采取积极应对措施。
Maritime Performing Party system is firstly design in Rotterdam Rules,set fundamental basis of liability of No-contractual parties,enlarge the scope of No-contractual parties of liability,partial breakthrough the rule of relativity of contract,be benefit for claims remedies from the shipper,consignee so on,Maritime Performing Party take on the equal duties compensation,aggravate their burden cost,expect to greatly impact on China's shipping logistics.Chinese shipping industry should take countermeasures to R-R.
