论司法公正与我国司法体制的改革

On Judicial Justice and the Reform of Chinas Legal System

作者认为 ,我国现行的司法体制不利于司法公正 ,因此必须按照社会主义市场经济的客观需要和法治原则的要求对司法体制进行改革 ,在我国宪法的框架范围内从司法机关领导体制、经费管理体制以及法院内部机制等方面着手进行改革实践 。

The author maintains that Chinas legal system is unfavorable to judicial justice. Therefore it is necessary to reform the system according to the needs of socialist market economy and the ruling in accordance with law. The practice of reform should be based on the constitution and start from the leading system of the judicial organs, financial management, and the internal working system of the court. In the process of the reform, the legal supervision system should be improved.
