摘要
悬赏广告是以广告方式声明对完成一定行为的人给予报酬的意思表示,它含以下四方面特殊要件:采取广告形式;声明给予报酬;指明期待完成的特定行为;对不特定的人为之。悬赏广告的性质为契约之要约。总结我国各时期的实践经验,参考国外成功之处,以一定方式对悬赏广告的适用范围及报酬额度于以国家干预是必要的。
Reward in tile form of advertisement is a kind of activity to announce certain offer to general public for informa- tion. In the reward, the advertiser makes a statement about the reward for the assigned task. In nature the reward meets the four essential requirements - form of advertisement, reward announcement and task assignment, and meant to any individual agent. Based on the survey of the practices of reward- system in different different periods in our country and some suc- cess stories from foreign Practice, the paper points out that it is necessary for the state to intervene in the reward system within the sphere of application and amount of reward.
