摘要
商品房预售作为一种重要的房地产开发、融资、买卖手段,已经成为我国现行商品房交易中采用的主要销售方式。但在商品房预售实践中,由于预购人本身的弱势地位及对其权利保护的立法滞后等原因,预购人的权利经常遭受侵害。本文在分析预购人权利受侵害原因的基础上,结合商品房预售的基本理论,在现行法律框架下提出完善预售人权利保护的立法建议,为完善我国的商品房预售制度提供一定的参考。
As one of the important means for real estate developing, financing and trading, the housing pre-sale system becomes the primary form of real estate transaction. However, in practice, due to the weak position of pre-buyers and the lag in legisla- tions, pre-buyers' legal rights and interests are often infringed when they purchase houses. Therefore, based on the basic theory of housing pre-sale system, the essay studies the pre-buyers' rights, interests' protective systems, and tries to give suggestions to improving the commercial house pre-sale system in China
