A Preliminary Study of Environmental Resources Related Rights

环境资源相关权是为促进经济社会的快速发展以及应对环境资源危机而为的一种权利创设,它并非是一项具体的、特定化的权利,而是泛指一切与环境资源相关联的权利集合。环境资源相关权概念的提出,可以有效地克服环境权理论存在的诸多困境与不足。环境资源相关权在其价值功能上具有两面性:一方面,它是现代环境问题的重要诱因之一;另一方面,它又可以在一定程度上缓解与克服环境资源危机。

Environmental resources related rights are intended for enhancing economic development and coping with the crisis of environmental resources. They are not concrete and specific rights, but a bunch of rights related to environmental resources. The launch of the concept of Environmental Resources Related Rights will efficiently conquer hard problem and insufficiency of environmental rights.
