涉诉特困群体执行救助制度的价值分析

Value Analysis of the Relief Implementation System for theLitigation-related and Extremely Needy Group

"执行难"是生效民事裁判不能及时得到人民法院强制执行的情况。"执行难"既削弱了司法权威,使案件当事人对司法救济生出质疑,又影响社会和谐,聚集社会矛盾。倘若生效裁判的涉诉主体为特困群体,因其主体的特殊性,其执行问题就会变得难上加难,执行救助制度是破解涉诉特困群体执行难题的有效手段之一。采用多种手段对涉诉特困申请执行人进行必要的救济,既切实保障了涉诉特困群体的合法权益,在一定程度上解决了他们的现实窘境,又缓解了社会矛盾,凸显司法的权威性。目前,我国一些地区率先出台了相应规章,有针对性地对涉诉特困群体进行执行救助。通过价值分析的方法判断现存涉诉特困群体执行救助制度的价值,对该制度的目的价值和功能价值进行剖析,为建立全国统一的涉诉特困群体执行救助制度提供借鉴和参考。

Law enforcement difficulty issue is that effective civil judgments cannot be enforced in time by people＇s court. Law enforcement difficulty not only weakens the authority of the administration of jus- tice, which as a result makes the parties of cases question the judicial salvage, but also affects social har- mony and accumulates social conflict. If the litigation-related subjects of effective judgments are the ex- tremely needy group, implementation problem will become more difficult owing to the special subjects. A relief implementation is one of the effective means of solving the ＂implementation difficulty＂ problem con- cerning the litigation-related and extremely needy group. This relief implementation system takes advan- tage of many kinds of means to provide necessary salvage for the applicants of vulnerable groups. Such necessary salvage protects the legitimate rights and interests of especially difficult groups, solves present difficult situations encountered by the litigation-related and extremely needy groups, relieves social conflict and upholds the authority of the administration of justice. At present, some relevant regulations have first been published in some Chinese districts aiming at helping such an extremely needy group. Value analysis is applied to judge the value of present relief implementation system for litigation-related and extremely needy group. Analysis on this system＇s value of aim and function can offer reference for establishing na- tional relief implementation system for the litigation-related and extremely needy group.
