我国农村土地使用权流转的法学思考

Viewpoints about Rural Land Usufruct Circulation

随着中国社会主义市场经济的快速发展,通过土地流转实现土地资源的优化配置已经成为不可阻挡的趋势。现实中,农村土地流转存在着制度缺位导致土地争端、集体土地所有权主体虚置等问题,需要土地承包经营权流转的条件应当严格法定;取消现行法律对土地承包经营权主体的限制性规定;构建科学、完善的土地承包经营权流转方式体系;完善农村集体土地产权制度;加强相关的配套制度改革,尽快出台相关法律,从国家立法上给予农村土地市场化以规范管理,以期促进我国农村土地流转的进一步发展。

With the rapid development of socialist market economy, the optimal allocation of land resources through the land circulation has become an irresistible trend. In reality there are many problems in rural land circulation .For example, the absence of system l^ads to land disputes, collective land ownership virtual set, etc. and conditions of circulation land contracting authority should be strictly statutory to cancel the restrictive provisions to the main body of the circulation land contracting authority of current law; to build perfect scientific way of circulation land contracting authority, improve the property right of circulation land contracting authority ; to strengthen the relevant system reform, to legislate the relevant laws as soon as possible, to make rural land market management be standardized , in order to promote further development of rural land circulation.
