On the Legal Responsibility of the Government in the Regulation of Illegal Pyramid Schemes

非法传销作为一种资本运作方式,几乎与合法的直销行为相时而生,如何正确认识非法传销的本质,如何充分发挥政府在调整经济运作方式、规范社会秩序中的作用,是当前面临的现实课题。文章拟从传销与相关概念的关系理清,现行法律对非法传销的刑法规定等方面展开分析,提出政府在规制非法传销中的责任,以深层次、多维度举措加强对非法传销的打击力度,切实维护正常经济秩序,构建社会主义和谐社会。
