WTO规则下两岸经贸关系正常化问题探讨

The Discussion of Normalization of Cross-strait Economic and Trade Relations Via ECFA Based On the WTO Rules

本文应用博弈论等研究方法,依据两岸同为WTO成员以及ECFA是WTO框架下的区域合作形式等客观事实,论证两岸经贸合作的法理依据及正常经贸关系,分析两岸建立正常经贸关系的现实基础及现存差距,界定两岸经贸关系正常化的涵义,探寻消除差距、实现两岸经贸关系正常化的基本路径。

Scholars all agreed that economic and trade normalization is the basic of cross-strait economic cooperation mechanism, ECFA has provided important factors for normalization and institutionalization of crossstraits economic relations. But to what is the normal trade relations, what is the connotation of normalization and how to realize via ECFA, few literatures involved. In view of this, based on the author and other scholars＇ researches, concerning that both sides are WTO members and ECFA is under the framework of WTO. This paper using game theory demonstrates the legal basis and reasonable state of cross-strait trade and economic cooperation, then analyzes the existing basis and the gap between the ideal and reality, specifically defines the meaning of normalization, and explores the path via ECFA to remove the gap and achieve the normalization of cross-strait economic and trade relations.
