国际货运代理企业汇率损失纠纷研究

Research on Dispute of International Freight Agent Enterprise Exchange Rate Loss

随着美元对人民币的汇率持续疲软,汇差对我国货运代理企业的影响不可小觑,越来越多的货运代理纠纷案件中附带了请求汇兑差价的主张,但是我国海事法院的审判实践中,对于汇率损失是否应该支持,以及如何确定汇率损失的起算点,仍然存在不少争议。论文中分析了关于汇率损失纠纷的原因,剖析了汇率损失纠纷中存在的争议,并对如何减少汇率损失纠纷提出了建议,以期对我国货代企业防范汇率损失的风险有所裨益。

With the continued weakness in the US dollar against the RMB exchange rate,the exchange differences of freight forwarding enterprises should not be overlooked,more and more freight forwarders dispute case with the request that exchange price difference,but in China＇s maritime court trial practice,whether the exchange rate loss should be supported,and how to determine the date of the loss of the exchange rate,there are still a lot of controversy.This paper analyzes the reasons for the loss on exchange rates,and the existing controversial of exchange rate loss dispute,then gives some suggestions for freight enterprise of our country to reduce losses disputes exchange rate and prevent the risk of exchange rate losses.
