保护少数人权利是我国法律、人权保护、维护文化多元性的要求,存在着少数人界定、民主性、价值、立法取向的悖论。解决少数人权利立法保护问题,要准确界定少数人群体及个人,民主立法中保护少数人权利的立法主体,确定少数人权利保护立法的法律价值,立法程序应在法律框架内实现民主协商。

The protection of minority rights is required by China＇s laws,human rights protection and cultural diversity maintaining.There exist paradoxes in the definition of minority,democracy,value,and legislative orientation.To solve the problem of legislation protection of minority rights,we need to correctly define minority groups and individuals,protect minority rights in democratic legislation,determine the legal value of the protection,and realize democratic consultation under the legal framework.
