刍议我国遗嘱信托制度的建构

On the Construction of Testamentary Trust System in China

遗嘱信托是一种新型法律制度,具有诸多方面功能,应当成为民众安排身后事的理性选择。但其未能在我国得以实践及发展。本文从分析遗嘱信托在我国具有存在必要性及可行性出发,提出建构我国遗嘱信托制度的设想,以利减少继承纠纷,并对完善我国遗嘱信托法律有所裨益。

Testamentary trust is a new type of legal system. It contains many functions. It should be the rational choice for arranging matters after death. It has not he practised and developed in our country. Beginning with analysing testamentary trust has necessity and possibility in our country, and then it proposes the suggestions on the constructing testamentary trust system in our country for reducing succession dispute, which is to be beneficial for the rules or regulations of testamentary trust in China.
