Legislative Perfection of Gold Reserves in China:A New Analysis Framework

金融危机发生后,尤其是在我国外汇储备突破三万亿大关后,为减少金融风险,学界更多的开始关注黄金储备,对黄金储备应增持还是减持、如何对黄金储备进行动态管理等一系列的争论接踵而至,无可厚非的是黄金储备在黄金非货币化后依然有其独特的作用。而目前,我国却对黄金储备实行消极的监管和调控,制度的滞后和缺失越来越引起学界的重视,对黄金储备的立法完善问题进行研究,有着深刻的理论价值及现实意义。

After the global financial crisis,especially when Chinese foreign exchange reserves exceeded three trillion,the academic circle start to pay more attention to gold reserves in order to reduce financial risk.There follow a series of arguments about how to keep the proper scale of gold reserves and how to make dynamic management of gold reserves.It＇s understandable that gold reserves has its unique role after non-monetary,but at present gold reserves are passively regulated and controlled.The academic studies more emphasis on the hysteresis and absence of the system.So studying the legislation improvement of gold reserves has profound theoretical value and practical significance.
