论我国行政征收补偿程序的不足及完善

On Defects and Perfection of Administrative Expropriation Compensation Procedure in China

行政征收是指行政主体为了公共利益的需要,按照法定的程序,以强制方式取得私人不动产的所有权或其他物权的行为。我国的行政征收补偿程序主要分为土地征收补偿和城市房屋征收补偿。但目前我国的行政征收补偿程序仍存在诸多问题,如征收目的不明确,征收程序启动较随意化,征收补偿缺乏统一而明确的程序规则等,需要进一步完善。

The administrative imposition means the administrative subject obtains private property on the benefits of public interest through legal procedure.The administrative imposition compensation in our country includes the land expropriation compensation and the urban housing expropriation compensation system.However,there are still many problems in the administrative imposition compensation procedure,such as the purpose of imposition is obscure,the procedure of imposition is informal and the rules of imposition compensation is not uniformed.We should try to solve these problems.
