Research on Crime of Safety in Building and Construction:Based on the Crime Theories

建筑安全犯罪是指在在建筑工程的施工、装修和使用过程中,由于当事人在管理和施工中的过错,造成建筑物和施工存在安全缺陷,以致造成伤亡事故或者财产损失的犯罪。对其进行犯罪学意义上的阐释,有利于该类犯罪的预防、立法的完善和司法上的操作。

The crime of safety in building and construction refers to the offences committed during construction,decoration and utilization of the buildings,which results in heavy casualties and serious damages due to the interested party＇s poor management and the fault in construction.According to provisions of the criminal law of our country,the crime of safety in building and construction is related to such offences as serious accidents arising from negligence,labor safety and project.This article develops the crime in building safety from criminology and science of criminal law so as to prevent the crimes,improve our legislation and operation of justice.
