Because Criminal Statutes has achieved complete dominance,criminal customary law that is a real and effective existence has always been on a state of edge.However,Criminal customary law plays an important role in the process of legislation construction,which can adjust criminal disputes in ethnic minority areas.Firstly,the article points out the present status of judicial application about Criminal customary law.Secondly,it analyses basis of judicial application about Criminal customary law.Lastly,it discusses how to introduce Criminal customary law into judicial practice.
