Study on Several Issues in Common Crime

共同犯罪中"利用"式犯罪是司法实践中经常遇到的一类案件,这类案件具体包括三种类型:一种是"单纯"利用式犯罪,即对他人的前行为持肯定态度,但其与他人无意思联络,仅仅是"单纯"利用他人的先前行为产生的效果或者影响作为自己犯罪的有力工具;另一种是"复杂"利用式犯罪,即与前行为人形成意思联络介入到犯罪中,利用前行为的效果或影响单独或者与他人共同实施犯罪;第三种是在被利用人始终知情的情况下,利用人利用被利用人的行为实施犯罪,但二人又无意思联络。

＂Use＂ type of crime is often encountered in the judicial practice of a class of cases,such cases include three specific types： one is the ＂pure＂ style crime to use,that is,before the behavior of others,positive attitude,but with others no means to contact,just a ＂simple＂ to use another person＇s previous behavior of the effect or impact as a powerful tool for their crime;the other is the ＂complex＂ to use type of crime,that is with former actors involved in the formation of the meaning of contact crime,use of the former effect or influence behavior alone or jointly with others to commit the crime;third person is always informed by the use of the case,the use of human use of human behavior being used to commit the crime,but the two nor the means to contact.
