人格物视野下人类基因的法律定位

Research on the Legal Position of Human Gene from the Perspective of the Personhood Property

脱离人身的基因,系人格之物化,具有物质与信息、人格与财产的双重属性,与传统民法上人与物的二元界分不无隔阂。故对基因的定位,势必要破除传统束缚,以新的思维或视阈洞见、透识问题。将人类基因定位为人格物,既是人类基因的特性使然,亦旨在透过基因物权实现对人之精神利益的周延保护。

From personality into property,human gene which separated from human body,has the double properties of material and information and mixture characters between personality and property.But it＇s not compatible with the traditional civil law on the distinction between personality and property.So the legal position of human genes certainly will break traditional constraints and seek a new way of thinking or a new vision to insight into the problem.For viewing human gene as the personhood property,it is not only depends on the features of the human gene,but also based on the protection both the gene property interest and the spiritual interests above it.
