Marriage and family,which is related closely to human,is characterized by the Marriage Law which reflects the changes of marriage and family.Human subjectivity is strengthened in the marriage and family from the perspective of human history.It is interpreted through rationality,freedom,equality,fairness and so on.The judicial interpretation III of the Marriage Law interprets the connotation of subjectivity in the process of social transformation in China.
