和谐语境下完善我国的未决羁押制度

Perfect of China's system of pretrial detention in the harmony context

我国的未决羁押制度存在着逮捕未与羁押实行分离、羁押场所侦查化、超期羁押、羁押适用率高等诸多问题有待于进一步的深入研究与完善。文章从我国当前未决羁押制度的现状出发,对存在的弊端及其原因进行剖析,并以联合国刑事司法准则为标准,在借鉴其他国家的经验的基础上,提出完善我国未决羁押制度的一些具体措施。

China＇s system of pretrial detention has some problems such as no separation between the arrest and detention,which demands further study and improvement.The author analyzes the existing problems and their causes and then puts forward specific measures.
