火车票售票方式改革后倒卖车票犯罪认定研究

Research on Identification of Crime of Speculative Reselling of Train Ticket After Ticket Selling Is Reformed

倒卖车票罪系传统犯罪,但火车票售票方式改革后其又出现了新的犯罪形式,这导致在司法实践中对该类新型倒卖车票行为的定性上产生了一定的困难。本文从火车票售票方式改革带来新的犯罪形式出发,在廓清倒卖行为的基础上,对几种新型倒卖车票行为进行分析,以期对司法实践在处理该类新型倒卖车票行为的处理提供帮助。

The crime of speculative reselling of train ticket is a traditional offence. However, new crime forms have appeared after the ticket selling is reformed, which causes difficulties for identifying the new actions of reselling train ticket speculatively. The author started from the new crime forms resulted from the reform of ticket selling, analyzed several new speculative reselling of train ticket so as to give helps for solving the new speculative reselling of train ticket.
