对于网络服务提供者的责任认定问题,《侵权责任法》网络侵权条款吸收借鉴了"避风港"规则,但该规则在适用中遇到一些障碍,这些障碍的解决,以及实施具体侵权行为的普通网络用户难以被究责等问题,还有赖于相关法律法规、配套制度和机构以及文明网络环境的构建和改良。

As for the network service providers＇ responsibility identification,Network Tort Terms of Tort Liability Law has absorbed and drawn on lessons from ＂safe harbor＂ rule which encounters some applying obstacles.The relevant laws and regulations,institutions,supporting system and civilized network environment should be constructed and improved so as to overcome these obstacles and solve the problem that it is difficult to investigate the ordinary Internet users＇ liability for their specific infringing acts.
