摘要
随着改革开放的不断深入,劳资关系日趋复杂化,劳动争议案件发生率呈明显上升趋势,涉案范围广,涉案金额大,案因越来越复杂。这给现行的劳动争议处理机制带来了挑战,也使得现行劳动争议处理机制的弊端日益显现。一些劳动争议案件如果得不到及时、有效解决,劳动者的合法权益就会受到损害,因此,有必要评析我国现行劳动争议处理机制存在的缺失,并提出进一步完善的建议。
In recent years, with the further reform and opening, the labor and capital relations are becoming increasingly complicated, and labor dispute cases keep increasing, involving great range and sums of money. Such cases have become more and more complicated, which challenges the current labor dispute mechanism and which makes the malpractices of the labor dispute mechanism come into being daily. If some labor dispute cases cannot be effectively dealt with timely, laborers' legal right will be infringed upon. Therefore, it is necessary to analyze the malpractices and offer some suggestions to further perfect the labor dispute mechanism.
