摘要
在当代西方冲突理论的视野下,行政权限冲突可分为横向冲突、纵向冲突和积极冲突、消极冲突,并在分析行政权限冲突负功能的基础上肯定其正功能。冲突理论提出以疏导方式化解冲突,在此指导下,内部协调作为行政权限冲突的主要化解路径既有合理性也存在缺陷。借鉴日本的经验,机关诉讼应作为内部协调方式的辅助化解路径,并界定其适用范围,回归人民利益至上原则,建立立体法律体系。
The conflicts of the administrative rights and pessimistic ones. The conflict theory suggests that may be categorized as horizontal, vertical, positive persuasion be adopted to the settlement with internal coordinations. This is both rational and misleading. This paper argues for the top priority of benefits for the people on the basis of a sound legal system assisted with internal coordinations.
