农村基层组织人员职务犯罪研究

当前农村基层组织人员职务犯罪呈现出身份特殊、作案手段多样、涉及领域多元、社会危害扩大的特点。其根源在于资源的有限性导致经济的逐利性。而刑法等部门法的缺陷、社会监管的松弛、基层领导和监察的不力以及个人思想的蜕化也起到了辅助作用。因此,切断权力行使的经济利益链、构建完善的法律惩处机制、加强公务公开、创新基层领导及监察模式、提高村干部的思想意识是推动农村职务犯罪有效预防、惩处和监管的明智之举。

The current rural grassroots organizations＇duty crime presents some traits such as special identity,various means of committing crime,involving multivariate fields and expanding social harm.The root of duty crime is that the limitation of resources leads to the chase of interests in financial terms.The defects of criminal law and other laws also play an important role in promoting it,as well as the relaxation of social supervision,the weak leading and supervision,and degenerating personal thoughts.Therefore,a wise way to the prevention,supervision and punishment of duty crime shall include cutting off the chain of economic interests,building perfect legal punishment mechanism,strengthening the publication of official business,innovating grassroots leading and monitoring mode,and improving the village cadres＇ideological consciousness.
