学生在校学习和生活过程中,来自校内外的侵权行为往往造成学生权益受到损害。一般来说,侵害学生权益可以分为学校行为、同学行为、校外第三人行为的侵权责任形态。由于侵权主体的过错程度的不同,依循《侵权责任法》及其侵权行为原理,不同的侵权责任形态,其法律责任主体和责任关系呈现多样性。因此,正确处理各类侵害学生权益的事件,需要厘清各种侵权责任形态,依法追究侵害人的责任,保护各方的合法权益。

The violations from internal and external campus often cause damages to the rights and interests of students when they study and live in schools.Generally speaking,the damages to the rights and interests of students can be caused by schools,classmates and extramural people.According to the Tort Liability Act and its basic principles,the subjects and relations of legal liabilities are various.Therefore,it is necessary to distinguish the various modalities of tort liabilities and investigate the infringers＇ responsibilities for the violation,in order to handle properly all types of violations and protect the students＇ legitimate rights and interests.
