摘要 传统的建筑垃圾处理方式在我国加速城市化的进程中产生了严重环境问题。基于循环经济理论与废弃物管理可持续理论,构建建筑垃圾循环利用法律制度是对其进行综合治理的根本途径。针对我国现有法律制度无法满足建筑垃圾循环利用的现状,在借鉴德国与日本相关法律制度的基础上,从延伸生产者责任制度、押金制度、分类回收收费制度、行业准入制度、再生产品保障制度几个方面探讨了我国建筑垃圾循环利用法律制度的建构。 The traditional way of processing the construction waste brings severe environmental problems,so formulating the construction waste recycling regulations,which is based on the circular economy theory and the theory of sustainable waste management,is the fundamental way to deal with construction waste comprehensively.However,the current legislation of the disposal solid waste cannot suffice the need of the recycling of the construction waste,and by drawing on the relative experience of Germany and Japan,we should take extended producer responsibility system,deposit system,charging system based on waste classification,recycling and recovery access system and promotion of the regenerated-product system into consideration while probes into the establishment of the construction waste recycling regulations.
