平衡劳动关系的冲突与合作——关于和谐劳动关系的理论思考 被引量:4

摘要 研究表明冲突是劳动关系的本质特征,而实现和谐劳动关系的途径是平衡主体权利,通过集体调整的方式,用合作解决冲突和矛盾。冲突性是由市场经济下生产资料占有程度和劳动目的不同,以及由此导致的利益差异所决定的。而利益、权利、制度的失衡就会造成冲突的激化,而平衡是实现和谐劳动关系的主要途径,集体调整则是平衡的有效手段,所以政策和法律也应以平衡主体、权利和过程为导向,以集体劳动关系为重点。 Some research shows that conflict is an essential feature of labor relations,but the way to realize harmonious labor relations is to balance the rights of actors,and resolve conflicts through collective adjustment.Therefore,in policy making and legislation,we should pay attention to the balance between actors,rights and process of collective labor relations.
