论我国行政程序中公众参与机制的完善

On the Consummation of Public Participation Mechanism in China's Administrative Procedures

行政程序中广泛、深入、多样、富有成效的公众参与,是行政行为合法正当与可接受性的必要条件,是当代行政法治的基本特征。完善我国行政程序中公众参与机制,应提高公众参与积极性与技巧、增强听证程序的可操作性、建立健全协商制度、推动有组织参与、扩大政务信息公开和强化参与权利保障。

The extensive, thorough, various and productive public participation in administra- tive proceedings, is a necessity to ensure the legitimacy and acceptance of the administrative ac- tion. It is also the prime characteristics of contemporary administrative legal system. The author puts forward that to perfect public participation mechanism in our country＇s administrative pro- cedures, measures should be taken to improve the public participation enthusiasm and skills, en- hance the maneuverability of hearing procedure, establish and perfect the consultation system, promote the organized participation, widen the channels of government information publicity and strengthen guarantee measures of the participation right, etc.
