双重结构的水库移民社会保障:解魅与制度构建——基于开发性移民补偿的视角

Duality of Social Security for Reservoir Resettlement:Disenchantment and System Set-up——from the Perspective of Resettlement through Development Projects

开发性移民政策目标的实现,不能仅止于对水库移民提供补偿,还需建立完善的水库移民社会保障制度。而当前水库移民社会保障制度构建存在着双重错位倾向的法理困境。为了摆脱困境,实现水库移民社会保障与损失补偿制度的对接与协调,需要构建双重结构的水库移民社会保障制度体系。

In order to realize the goal of resettlement through development projects, we should not only compensate for reservoir reset- tlement, but also establish the system of social security for reservoir resettlement. But currently there exists a legal dilemma. In or- der to get out of trouble, we need set up dual structure of social security for reservoir resettlement.
