摘要
本研究着眼于美、日知名大学的章程,从概念辨析、制度源流和文本结构等方面展开比较研究。由于两国高等教育法律体系和大学治理传统的差异,两类大学章程的文本构成和本质定位都有不同。研究通过揭示现代大学治理制度的多样性,为中国大学章程建设厘清不同体系的参考与比较依据。
This article investigates the charters of American and Japanese well-known universlues. Dy exploring a comparative research, this study focuses on the following aspects： different concepts, regulation systems and text structures. Since the two countries have different law principles and traditions of university governance, the components and definitions of charters are various. By revealing diversities of those modern university regulations, we clarify charters of various higher education systems which Chinese universities may refer to.
