我国渎职侵权犯罪立法完善若干问题探讨

Discuss on the Various Problems of the Dereliction of Duty Crime's legislation Perfection in our Country

渎职侵权犯罪作为一类重要罪名,在近几年来,发案率持续上升,从最高人民检察院以及各省市公布的目前全国各省市检察机关所查处的渎职侵权犯罪的工作报告来看,除了受到社会等大环境的影响,渎职侵权犯罪发案率居高不下的一个重要原因是渎职侵权立法存在问题,应从合理限定渎职侵权类犯罪的主体范围、调整渎职侵权犯罪的立法模式、明确量刑情节标准、合理配置刑罚对渎职侵权类犯罪的立法等方面予以完善。

In the recently years,as a class of important crime,the rate of the dereliction of duty is heightening continuously.From the report of the supreme people＇s procurator and the various provinces and cities nationwide procurator organs,the reason of the high rate of the dereliction of duty is that the legislation has shortcomings and it should be made perfect from the points of the reasonable limit to malfeasance crime subject,of the adjustment of malfeasance crime legislation pattern,of the sentencing standards of the explicit and of rational allocation of punishment on malfeasance crime legislation perfection.
