摘要
行政调解作为诉讼外替代性纠纷解决机制(ADR)的重要组成部分,其依法形成的行政调解协议不具备强制执行力,导致权利人诉累增加、义务人违约成本低廉,以及行政、司法资源的双重浪费和行政机关专业技术优势无法发挥等问题。基于效力位阶、政治文化传统的视野,行政调解协议均应具备可申请强制执行的应然效力,并就赋予行政调解协议强制执行力提出可行性建议。
As an important part of Alternative Dispute Resolution, administrative mediation has many problems such as indefinite mediation effect, increased burden for the obligee, low cost for the obligor to break a contract,double wastes in administrative and judicial resources and inadequate use of professional strength in administrative offices,etc. This paper analyzed the due power and legal princi- ples of the administrative mediation agreement from the perspective of effect stratum and tradition of political culture, and put forward feasible suggestions for the authorization of executive power to the administrative mediation agreement.
