高校治理应重视软法。高校治理的软法有三种基本形式:有关高等教育的法律、法规、规章(硬法)中的软法条款;党和国家机关制定的有关高等教育的规范性文件;高等学校自身制定的各类管理规范。高校软法之治的机制包括:自愿服从、激励机制、内部强制服从、社会强制服从和国家强制力的影响。高校治理的软法存在内容、制定技术和问责性不足问题。完善高校治理需构建软硬兼施的治理格局。
