摘要
学校法人身份的获得是我国20世纪80年代教育管理体制改革的一项重要内容。通过对该措施出台的背景、学校法人身份面临的困境、法人制度和学校教育制度的发展历史的审视,可以看出这一措施并不能有效解决学校与政府之间的关系问题。必须从公法的角度重新思考学校法人身份问题,并在政府管制与学校自主之间保持合理的度,才能为学校的发展提供良好的制度环境。
To obtain the status of school legal person is an important reform of educational administrative system in the 1980s in China. Through the survey on the investment on the background of the action, the plight of school legal person, and the history of the system of education and legal person, it is found out that the countermeasure can not effectively solve the problem between school and government. The legal status of school must be considered from the point of view of public law, and maintain a reasonable degree between government regulation and school self-management, only in this way can we provide a better system environment for the develooment of school.
