摘要 社会管理创新必然要对现有制度进行大胆突破和变革,但法律规范天生的滞后性使得若干顺应时代发展的举措一再突破法律规定的"底线",这显然与传统"法律保留"原则的各种理论相悖。根据中国现阶段的实际情况,在法律保留的各种学说当中,理性地选择适用"机关功能说",可以有效化解这一悖论。同时,立法机关也要尽快完善相应立法,确保行政机关有法可依,依法行政。 Social management innovation is bound to break the existing system and changes dramatically,however,the lagging inherent legal norms of the times makes a number of developmental initiatives repeatedly break the law of the "bottom line".This is obviously contrary to the various theories of the traditional "principle of legal reservation ".Application of rational choice,"theory of unit function",among the various theories of legal reservation,can resolve this paradox effectively according to Chinas actual situation at the present stage.At the same time,the legislature should expedite the development of appropriate legislation and ensure that the executive law is enforced legally.
