论我国地理标志立法模式之探析

我国地域广博、历史悠久,地理标志资源相当丰富,比如陕北小米、横山羊肉、乌江榨菜、贵州茅台。当下,我国主要采取商标法与地理标志产品保护这两种并行保护模式来对地理标志进行保护,但是这两种保护模式在当前制度层面上有着难以调和的冲突和矛盾。在这种背景下,有的学者主张采取"商标法+反不正当竞争"的模式进行保护,还有的学者主张另行单独立法,制定专门的地理标志保护法律等等。笔者从地理标志的法律属性入手,立足基本国情,认为应当采取商标法与专门立法这种双轨制来对地理标志进行保护。
