近代日本多版本《万国公法》考察

Investigation of Multi-version “Elements of International Law” in Modern Japan

西方列强以"万国公法"为理论工具打开日本锁国大门后,日本的思想家、政治家们便采取了多种手段引进西方的法律制度。其中,多版本的《万国公法》在近代之初的日本纷纷登场,成为日本近代法体系的有机构成。与此同时,其自身伴随着近代日本社会的发展变化而变化,并表现出不同的阶段性特征。这些特征所表现出的实质意义在于:为日本社会不同时段的需求提供了理论武器。考察近代日本多版本《万国公法》,可以发现日本走上战争道路的法理原因。

Since the western powers opened the door of ＂secluded Japan＂ by the theoretical means of Elements of International Law, the ideologist and politicians introduced the western legal systems into Japan by various means. In it, multi-version ＂Elements of International Law＂ appeared on the stage in Japan at the beginning of modern times. At the same time when they became the organic component of modern Japanese legal system, it accompanied the development and changes of modern Japanese society itself, showing different traits in different phases, it provided the theoretical weapon for different stages of Japanese society.
