论过度医疗中患者知情同意侵权责任

On Tort Liability of Informed Consent of Patients in the Excessive Medical Treatment

过度医疗是一种特殊的医疗侵权行为。在过度医疗中,医师不履行相应的告知义务或者履行了"非真实性"告知义务所实施的过度医疗行为造成患者人身、财产权益损害并由此侵害了患者的知情同意权。过度医疗中由于医师履行告知义务的违法性与患者知情同意侵权行为产生竞合,在过度医疗侵权法律救济中,这两种侵权诉由皆可适用。

The excessive medical treatment is a special kind of medical tort action. In excessive medical activities, the exces- sive medical treatment generated by the nonfulfillment of informing obligation or the fulfillment of ＂unreal＂ informing obli- gation results in the body of the patient, the property rights and interests damage and thus violated the right of informed consent. In the excessive medical treatment, the illegality of fulfilling informing obligation by physicians leads to concur rence with patients informed consent in tort. The reason for lawsuit of the two torts can be suitable in excessive medical tort relief.
